General Terms and Conditions (GTC)

1. Scope
These General Terms and Conditions (GTC) apply to all orders placed through the online shop www.nevyra.ch, operated by:

By placing an order, the customer agrees to these GTC.
2. Offer
The products displayed in the online shop do not constitute a legally binding offer but rather an invitation to place an order.
Product images are for illustrative purposes and may differ slightly from the product delivered.
3. Conclusion of Contract
The purchase contract is concluded once the customer submits an order and Nevyra confirms it by email or dispatches the goods.
Nevyra reserves the right to reject or cancel orders without stating a reason, particularly in cases involving:
- obvious pricing errors,
- supply shortages,
- suspected fraud,
- misuse of the online shop.
Any payments already made will be refunded in full in such cases.
4. Prices
All prices are stated in Swiss francs (CHF).
As Nevyra is currently not subject to VAT, Swiss VAT is not shown separately.
For deliveries outside Switzerland, additional import duties, customs fees, or taxes may apply. These costs are borne by the customer.
5. Payment Methods
The following payment methods are accepted:
- Shopify Payments
- TWINT
- PayPal
- Other payment methods offered at checkout
Payment is charged immediately after the order has been completed.
6. Delivery
Deliveries within Switzerland are generally made via Planzer Paket.
The usual delivery time is 1 business day, unless otherwise stated on the relevant product page.
Deliveries to other countries may take longer.
If a product is temporarily unavailable, Nevyra will inform the customer as soon as possible.
7. Shipping Costs
Shipping within Switzerland is free of charge.
For deliveries outside Switzerland, customs duties, import taxes, or other government charges may apply. These are not included in the purchase price and are borne by the customer.
8. Retention of Title
The goods remain the property of Nevyra until payment has been made in full.
9. Minimum Age
Orders may only be placed by persons who are at least 18 years old or who are acting with the consent of their legal representative.
10. Availability
If, contrary to expectations, a product becomes unavailable after the contract has been concluded, Nevyra may withdraw from the contract.
Any payments already made will be refunded in full. No further claims shall arise.
11. Voluntary Right of Return
Nevyra grants customers in Switzerland a voluntary 30-day return period from the date the goods are received.
A return is only possible if:
- the product is unused and undamaged,
- the product is in its original packaging,
- all accessories are complete.
For hygiene reasons, hair care or styling devices that have already been used or damaged may be excluded from returns unless a statutory warranty claim applies.
The customer bears the cost of return shipping unless otherwise agreed.
12. Refunds
Once the returned goods have been received and inspected, the refund will be issued within 14 days using the original payment method.
Alternatively, at the customer's request, Nevyra may provide a replacement product where possible.
13. Warranty
The Nevyra AeroFlow comes with a 24-month warranty from the date of purchase.
The warranty covers material and manufacturing defects occurring under normal use.
The warranty does not cover, in particular, damage caused by:
- improper use,
- drops or water damage,
- unauthorized repairs or modifications,
- normal wear and tear,
- failure to follow the operating instructions.
In the event of a valid warranty claim, Nevyra may, at its discretion, repair the product, provide a replacement, or issue a refund.
14. Statutory Warranty Rights
The statutory warranty provisions of the applicable law apply.
Any obvious defects should be reported to Nevyra as soon as reasonably possible after receiving the goods.
15. Transport Damage
If externally visible transport damage is identified, it should, where possible, be noted directly with the delivery provider and reported to Nevyra without delay.
The customer's statutory rights remain unaffected.
16. Product Safety
The Nevyra AeroFlow is intended exclusively for drying and styling human hair.
In particular, the device must not:
- be immersed in water or other liquids,
- be used near bathtubs, showers, or washbasins containing water,
- be operated with a damaged power cord,
- be left switched on unattended.
The safety instructions in the user manual must be observed before each use.
17. Plug Variants
Depending on the sales region, the Nevyra AeroFlow may be supplied with different types of power plugs.
If, for logistical reasons, a device is temporarily supplied with an EU plug, a suitable adapter will be included where required.
This does not constitute a product defect.
18. CE Conformity
The Nevyra AeroFlow complies with the legal requirements applicable in the respective sales region.
Where required by law, the product bears the necessary conformity markings and is supported by the required technical documentation.
19. Liability
Nevyra shall only be liable for damages caused intentionally or through gross negligence and within the scope of mandatory statutory provisions.
Liability for indirect damages, consequential damages, loss of profits, or loss of data is excluded to the extent permitted by law.
Liability under mandatory product liability laws remains unaffected.
20. Force Majeure
Nevyra shall not be liable for delivery delays or obstacles to performance caused by events beyond its reasonable control, including in particular:
- natural disasters,
- pandemics,
- strikes,
- government measures,
- war or similar events,
- disruptions to international supply chains.
In such cases, delivery periods will be extended accordingly.
21. Improper Use
Nevyra accepts no liability for damage caused by improper, unintended, or negligent use of the product to the extent permitted by law.
22. Intellectual Property
All content of the online shop, including trademarks, logos, product names, images, graphics, texts, designs, and other content, is protected by copyright and/or trademark law.
Such content may not be reproduced, published, modified, or used commercially without Nevyra's prior written consent.
23. Data Protection
Personal data is processed in accordance with Nevyra's Privacy Policy.
In connection with the operation of the online shop, Nevyra may use Shopify, payment service providers, shipping providers, as well as analytics and marketing services such as Google Ads, Meta Pixel, and TikTok Pixel.

24. Electronic Communication
By using the online shop, the customer agrees that communications relating to their order may be conducted electronically, for example by email.
25. Amendments to the GTC
Nevyra reserves the right to amend these GTC at any time.
The GTC published at the time the relevant contract is concluded shall apply to the order.
26. Applicable Law
These GTC are governed by Swiss law, excluding its conflict-of-law rules.
For sales to consumers residing in Member States of the European Union, mandatory consumer protection provisions of the consumer's country of residence remain unaffected.
27. Place of Jurisdiction
To the extent permitted by law, the place of jurisdiction for all disputes arising out of or in connection with these GTC shall be Fribourg, Switzerland.
Mandatory statutory jurisdiction provisions applicable to consumers remain unaffected.
28. Severability Clause
If any provision of these GTC is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The invalid or unenforceable provision shall be replaced by a legally permissible provision that comes as close as possible to the economic purpose of the original provision.
